The stamp duty and registration charges paid at the time of property purchase are eligible for deduction under Section 80C of the Income Tax Act, 1961 — up to ₹1,50,000 per financial year. How is stamp duty calculated in India?
Stamp duty is calculated on the higher of the actual transaction value or the government-set circle rate (ready reckoner/guidance value). The percentage depends on your state, city, buyer gender, and property type. The formula: Stamp Duty = Property Value × Stamp Duty Rate (%).
What is the difference between stamp duty and registration charges?
Stamp duty is a state tax levied on property transactions. Registration charge is a separate fee paid to register the sale deed with the Sub-Registrar's office. Both must be paid to complete a legal property transfer. Registration is typically 1% of property value, often with a cap.
Do women get lower stamp duty rates in India?
Yes! Many states offer concessions: Delhi gives 2% off (4% vs 6%), Punjab saves women 3%, Haryana gives 2% off. Maharashtra, UP, Rajasthan, Karnataka, Himachal Pradesh, West Bengal, and Uttarakhand offer 1–1.5% concessions. The property should be registered in the woman's name to avail the benefit.
What is the circle rate and how does it affect stamp duty?
The circle rate (called ready reckoner rate in Maharashtra, guidance value in Karnataka, collector rate in other states) is the minimum value set by the government for a particular area. Stamp duty is calculated on the higher of the actual sale price or circle rate — even if you buy property below the circle rate.
Is stamp duty tax-deductible in India?
Yes. Stamp duty and registration charges paid for a residential property are eligible for deduction under Section 80C of the Income Tax Act, up to ₹1.5 lakh in the year of payment. Commercial properties and resale of already-claimed properties may not qualify.
Can I get a refund on stamp duty?
Yes, in limited cases. If your property deal gets cancelled before registration, you can apply for a refund (typically 90–98% of amount after deducting processing fees). Karnataka allows up to 98% refund with proper documentation. Time limits apply — usually within 6 months of purchase.
Are stamp duty rates the same for urban and rural properties?
No. Many states have lower rates for rural/gram panchayat areas. For example, Rajasthan charges 5% (urban male) vs 4% (rural male). Haryana and Gujarat also differentiate. Always select the correct area type in the calculator above.
